Na última década, os planos de saúde coletivos acumularam alta de quase 400%, um aumento 4,5 vezes superior à inflação oficial do período. A disparidade atinge diretamente a maioria dos beneficiários, já que 83% dos usuários de planos de saúde estão vinculados a contratos coletivos, sejam eles empresariais ou por adesão. Entre 2015 e 2025, os reajustes médios nesses contratos chegaram a 383,5%, enquanto o Índice Nacional de Preços ao Consumidor Amplo (IPCA) registrou elevação de 84% e os planos individuais tiveram variação de 146,48%. Segundo dados da Agência Nacional de Saúde Suplementar (ANS), o setor de saúde suplementar atende 53 milhões de beneficiários em planos médico-hospitalares — o equivalente a 25% da população brasileira, atualmente estimada em 213,4 milhões de habitantes. Destes, mais de 44 milhões possuem planos coletivos por adesão e empresariais, que não têm reajustes regulados pela ANS. O aumento expressivo das mensalidades e dos custos dos planos coletivos tem impacto direto no consumo das famílias, especialmente na classe média , que enfrenta o encarecimento de itens essenciais, como alimentação. Em entrevista à Veja, André Braz, coordenador dos índices de preços da Fundação Getulio Vargas (FGV), relatou que diversas famílias têm aberto mão dos planos de saúde para preservar o mínimo de conforto financeiro. O avanço dos reajustes nos planos de saúde coletivos tem impacto no orçamento da maior parte das famílias, justamente porque essa modalidade domina o mercado da saúde suplementar no Brasil. Hoje, apenas 16,4% dos beneficiários (8,6 milhões de pessoas, conforme dados da ANS) estão vinculados a planos individuais e familiares, que têm o aumento anual regulado pela ANS. O advogado especialista em planos de saúde , Elton Fernandes, explica que isso se deve à escassez de planos individuais, o que levou muitos consumidores a migrarem para os planos coletivos empresariais, frequentemente contratados por meio de microempreendedores individuais (MEIs) ou pequenas empresas. Somados, esses contratos empresariais de pequeno porte já reúnem cerca de 5,4 milhões de beneficiários, que enfrentam reajustes mais elevados que os contratos individuais e familiares. Um levantamento do Instituto Brasileiro de Defesa do Consumidor (Idec) mostrou que, entre 2017 e 2022, os planos coletivos empresariais com até 29 vidas tiveram alta de 82,36%, e os coletivos por adesão subiram 74,33%, enquanto os planos individuais aumentaram 35,41% no mesmo período. Segundo Elton Fernandes, a Lei nº 9.656/1998 foi criada considerando que os contratos coletivos atenderiam médias e grandes empresas, enquanto as famílias ficariam nos planos individuais. Com a mudança do mercado, no entanto, muitas famílias acabaram migrando para contratos empresariais, mas sem o poder de negociação das empresas de grande porte. O especialista em planos de saúde relata que essa diferença de estrutura tem levado diversas discussões ao Judiciário, especialmente quando o contrato coletivo é composto apenas por membros de uma mesma família. Nesses casos, Elton Fernandes explica que os tribunais têm analisado a possibilidade de aplicar as regras dos planos familiares, que possuem limites de reajuste definidos pela ANS. "Sem margem para negociar as condições do contrato, o consumidor acaba apenas aderindo às regras impostas pela operadora. Essa falta de equilíbrio tem levado o Judiciário a analisar se seria mais justo aplicar, nesses casos, as normas dos planos familiares", detalha. O advogado especialista em reajuste de plano de saúde, Elton Fernandes, destaca que consumidores de planos coletivos enfrentam desafios adicionais diante dos reajustes elevados. Segundo ele, a transparência sobre os índices de aumento é um dos principais pontos de discussão, especialmente porque o cálculo do reajuste considera fatores como sinistralidade, faixa etária e número de dependentes. Em muitos casos, famílias inseridas em contratos empresariais — firmados por microempreendedores individuais (MEIs) ou pequenas empresas — têm buscado o Judiciário para questionar aumentos considerados impróprios ou solicitar que o contrato seja enquadrado nas regras dos planos familiares, que contam com limites regulatórios. Enquanto o índice de reajuste dos planos individuais e familiares foi fixado em 6,06% para o período de maio de 2025 e abril de 2026, um levantamento da consultoria Aon aponta que o reajuste dos planos coletivos em 2025 ficará entre duas médias possíveis: 13,7% e 21,8%. Diante desse cenário, o advogado especialista em Direito da Saúde em São Paulo , Elton Fernandes, aponta que há alternativas possíveis para tentar equilibrar os custos com saúde suplementar. Entre elas, estão medidas que podem tornar o plano mais compatível com o orçamento familiar, como a portabilidade de carências e o downgrade , que implicam redução de rede credenciada. "Nem sempre a solução está em mudar de operadora, mas em conhecer os direitos e as alternativas que a legislação oferece para ajustar o contrato à realidade financeira do consumidor", afirma Elton Fernandes.
